Terms of Use

1. The service
Akashiica is a digital legacy platform that allows users ("you", "the user") to store encrypted messages, documents and files ("vaults") and configure rules for their delivery to designated third parties ("recipients") at specific moments or conditions.
Akashiica is operated by its founding team from Costa Rica. The service is provided as-is and may evolve over time.
2. Eligibility
- You must be at least 18 years old to use the service.
- You must provide true information and keep it updated in your profile.
- One account per person. Creating accounts on behalf of another person without their explicit consent is prohibited.
- If you use the service on behalf of an organization, you declare that you have the authority to bind that organization to these terms.
3. Accounts and security
You are responsible for maintaining the confidentiality of your access credentials (password and 2FA code). You must immediately notify us at security@akashiica.com if you suspect your account has been compromised.
Akashiica is not responsible for losses resulting from unauthorized access to your account if that access was a consequence of the disclosure of your credentials.
4. Plans and pricing
Akashiica offers the following plans:

Prices may change. We will notify you at least 30 days in advance before applying an increase to your active subscription.
5. Payments and billing
Payments are processed by Paddle, our Merchant of Record. Paddle acts as a reseller of the service and is responsible for tax compliance (VAT, local taxes) in applicable jurisdictions. By subscribing, you also accept Paddle's Terms for Buyers.
Subscriptions renew automatically at the start of each period. You can cancel at any time from your account settings before the renewal date.
Refunds: Paddle applies a 14-day refund policy for new subscriptions. To learn about all cases in which a refund can be requested, the process and deadlines, see our Refund Policy.
6. Cancellation and effects
- You can cancel your subscription at any time. Access to paid features is maintained until the end of the billed period.
- When downgrading to the FREE plan, vaults exceeding the 3-vault limit will be placed in read-only mode. They will not be deleted, but you cannot create new ones or edit existing ones until you reduce the number to 3 or fewer.
- When you delete your account, all content is permanently and irrecoverably deleted, including vaults, recipients and delivery rules. This action cannot be undone.
7. Delivery triggers
Akashiica supports the following content delivery mechanisms:
- Manual: you activate the delivery directly from your account.
- Death confirmation: the trust contacts you designate can confirm your passing using a limited-validity token. Delivery occurs when the quorum of confirmations you configured is reached.
- Dead Man's Switch (Heartbeat): available in Premium, Family and Compassion plans. If you don't check in within the configured grace period, the system triggers delivery. You will receive warning notifications before activation.
- Scheduled: delivery occurs at a specific date and time you define when creating the rule.
Important: Akashiica acts as a technical intermediary. The decision to activate each trigger and to whom to deliver the content is yours. By configuring a trigger, you assume responsibility for ensuring recipients are informed and are the correct persons.
We do not guarantee that a delivery will reach its destination if the recipient's email is invalid, inactive or was blocked by their email provider. It is your responsibility to keep contact details up to date.
8. Acceptable use
By using Akashiica, you commit to NOT:
- Store illegal content, including child sexual abuse material (CSAM), material inciting violence, or information whose possession is a crime in your country of residence or in Costa Rica.
- Use the service to extort, threaten or harass other people.
- Attempt to access other users' vaults or accounts without authorization.
- Reverse engineer, decompile or attempt to extract source code from the platform.
- Use automated scripts to create accounts en masse or abuse the API.
- Resell or sublicense the service without written authorization.
We reserve the right to suspend or cancel accounts that violate these rules without notice and without refund.
9. User content
You own the content you store in Akashiica. By using us, you grant us a limited, non-exclusive and revocable license to store, encrypt and deliver that content according to your instructions.
Since all vault content is end-to-end encrypted, Akashiica cannot review its contents. Legal responsibility for the content you store rests exclusively with you.
10. Compassion Plan
The Compassion Plan is intended for people with verified terminal illnesses. By requesting it:
- You agree to upload a valid medical document (diagnosis signed by a licensed health professional) as evidence.
- You acknowledge that the document will be reviewed by our team and permanently deleted immediately after review.
- You understand that provisional Premium access is granted during the review period and may be revoked if the documentation is rejected.
- You accept that approval is discretionary and that we may request additional documentation if that submitted is insufficient.
Providing false documentation constitutes a serious violation of these terms and will result in immediate account cancellation.
11. Family Plan
When creating a family group or joining one:
- The Family Plan owner is responsible for payment and can remove members at any time.
- Group members can view the shared family vault but cannot access other members' individual vaults.
- When removed or leaving the group, your plan automatically reverts to FREE.
- Group invitations are valid for 24 hours.
12. Service availability
We strive to keep Akashiica available 24 hours a day, 7 days a week. However, we do not guarantee uninterrupted availability. We may perform scheduled maintenance with advance notice and experience unplanned outages.
In cases of prolonged service interruption, we will make our best effort to notify you and, if applicable, compensate with a subscription period extension.
13. Limitation of liability
To the maximum extent permitted by applicable law, Akashiica and its operators will not be liable for:
- Data loss due to misuse of the account, loss of credentials or voluntary deletion by the user.
- Indirect, incidental, special or consequential damages arising from use or inability to use the service.
- Delivery failures caused by incorrect or outdated recipient data.
- Disputes between the user and their recipients regarding delivered content.
- Actions of third parties, including sophisticated hacks that overcome our security measures.
Akashiica's maximum total liability to you for any claim will not exceed the amount you have paid for the service in the last 12 months.
14. Service modifications
We may modify or discontinue service features with a minimum notice of 30 days, except in cases of urgent security or legal requirements. If a material modification negatively affects your use of the service, you may cancel your subscription and receive a prorated refund of the unused period.
15. Changes to these terms
We may update these terms. We will notify you by email at least 15 days before changes take effect. If you continue using the service after that date, you accept the new terms. If you disagree, you may cancel your account before the effective date.
16. Applicable law and jurisdiction
These terms are governed by the laws of the Republic of Costa Rica. For any dispute that cannot be resolved amicably, the parties submit to the jurisdiction of the competent courts of San José, Costa Rica.
